1.1. These Terms and Conditions govern the relationship between JacksonBurgyst (hereinafter referred to as the "Lessor") and any individual or legal entity renting equipment (hereinafter referred to as the "Lessee").
1.2. By placing a rental order, the Lessee agrees to these Terms in full.
2.1. The Lessor provides the Lessee with temporary use of construction, garden, or other equipment as listed in the confirmed rental order.
2.2. Rental is granted for an agreed period, with fixed payment, based on a rental agreement (verbal or written).
3.1. A valid government-issued ID is required for renting equipment.
3.2. No deposit is required unless otherwise specified in advance.
3.3. The Lessor reserves the right to refuse service if there is reasonable concern regarding the safety or return of the equipment.
4.1. The Lessee is responsible for the proper use and safekeeping of the equipment during the rental period.
4.2. In the event of loss, damage, or misuse caused by the Lessee, they agree to cover the cost of repair or full replacement.
4.3. The Lessor is not liable for any indirect damage or loss resulting from improper use of the rented equipment.
5.1. All equipment must be returned by the agreed date and time.
5.2. Late returns without prior notice may result in additional charges.
5.3. If the Lessee needs to extend the rental period, the Lessor must be informed before the original return deadline.
6.1. In case of equipment malfunction not caused by the Lessee, a replacement will be provided free of charge.
6.2. If a replacement is not possible, a refund will be issued for the unused rental period.
7.1. All personal data provided by the Lessee is handled in accordance with Canadian privacy legislation.
7.2. JacksonBurgyst does not share customer data with third parties without explicit consent, unless required by law.
8.1. These Terms are governed by and interpreted in accordance with the laws of the Province of Manitoba and applicable Canadian federal law.
